Article 3
Applicability These general terms and conditions apply to every offer from the entrepreneur as well as to every distance contract and to every order between the entrepreneur and the consumer. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated that the general terms and conditions can be consulted at the entrepreneur and will be sent free of charge upon request by the consumer. If the distance contract is concluded electronically, the text of these general terms and conditions can be made available to the consumer electronically before the contract is concluded, in such a way that the consumer can easily save it on a durable medium. If this is not reasonably possible, it will be indicated where the consumer can consult the general terms and conditions electronically, and that they will be sent free of charge upon request.
Article 4
The offer If an offer has a limited duration or is subject to conditions, this will be clearly stated in the offer. The offer is without obligation. The entrepreneur is free to change and adjust the offer. The offer contains a complete and accurate description of the products and/or services offered. This description is sufficiently detailed to allow the consumer to properly assess the offer. If the entrepreneur uses images, these must be a true representation of the products and/or services offered. Obvious mistakes or errors in the offer do not bind the entrepreneur. All images and specifications in the offer are indicative and cannot give rise to complaints or cancellation of the contract.
Article 5
The contract The contract is concluded at the moment the consumer accepts the offer and complies with the stated conditions. If the consumer has accepted the offer electronically, the entrepreneur immediately confirms receipt of the acceptance of the offer. As long as receipt of this acceptance is not confirmed, the consumer can cancel the contract. If the contract is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and will ensure a secure web environment. If the consumer can pay electronically, the entrepreneur will take appropriate security measures. The entrepreneur may inquire about the consumer's ability to meet his payment obligations, as well as any facts or factors relevant to the responsible conclusion of the distance contract. If the entrepreneur has legitimate reasons not to conclude the contract, he may refuse an order or request, or impose special conditions.
Article 6
Right of withdrawal When purchasing products, the consumer can cancel the contract without giving any reason within 30 days. This period begins on the day after receipt of the product by the consumer or a representative designated by the consumer. During this period, the consumer must treat the product and its packaging with care. He must only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If the consumer exercises his right of withdrawal, he must return the product with all supplied accessories and, if reasonably possible, in its original condition and packaging, in accordance with the clear and reasonable instructions provided by the entrepreneur.
Article 7
Costs in case of withdrawal If the consumer exercises his right of withdrawal, the costs of returning the products will be borne by him, including the costs of returning them to the country of origin, i.e. our supplier in China. If the consumer has paid an amount, the entrepreneur will reimburse this amount as soon as possible, but at the latest within 30 days after withdrawal, provided that the product has already been returned or proof of complete return is provided.
Article 8
Exclusion of the right of withdrawal The entrepreneur may exclude the right of withdrawal for certain products, as specified in paragraphs 2 and 3, if this is clearly stated in the offer before the conclusion of the contract. Products excluded from the right of withdrawal include those made to the consumer's specifications, personal products, those that cannot be returned due to their nature, and those that deteriorate quickly.
Article 9
Price During the validity period stated in the offer, the prices of the products and/or services offered will not be increased, with the exception of changes due to VAT rates. Price increases are possible within 3 months of the conclusion of the contract only if they result from legislative regulations or provisions. After 3 months, price increases are only possible if the entrepreneur has provided for this in the conditions, and if they are due to legislative changes or the explicit consent of the consumer.
Article 10
Conformity and Warranty The entrepreneur guarantees that the products and/or services comply with the contract, the specifications stated in the offer, and the reasonable requirements of quality and usefulness in force on the date of conclusion of the contract. The provided warranty does not affect the statutory rights of the consumer. If the consumer detects a defect in the product, he must notify the entrepreneur within 30 days of receipt, by returning the product in its original condition. The warranty is only valid if the product is used correctly and in accordance with the entrepreneur's instructions.
Article 11
Delivery and execution The entrepreneur will take the greatest care in executing product orders. The place of delivery is the address provided by the consumer. Orders will be executed as soon as possible, but no later than 30 days after acceptance, unless otherwise agreed with the consumer. If delivery is delayed or partial, the consumer will be informed within 30 days of ordering and may cancel the order free of charge.
